1. Acceptance of Terms

By accessing or using Sports Ball Squares (the "Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

These Terms apply to all visitors, registered users, Commissioners, and Players (collectively "Users") who access or use the Platform in any way.

We reserve the right to update these Terms at any time. We will notify registered Users of material changes via email. Your continued use of the Platform after any changes constitutes your acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years of age to use Sports Ball Squares. By creating an account, you represent and warrant that:

  • You are at least 18 years old
  • You have the legal capacity to enter into a binding agreement
  • Your use of the Platform does not violate any applicable law or regulation in your jurisdiction
  • You are not located in a jurisdiction where participation in sports pools or grid-based prediction games is prohibited

If you are under 18, you are not permitted to use this Platform under any circumstances. We reserve the right to terminate any account we reasonably believe belongs to a person under 18.

3. Description of the Platform

Sports Ball Squares is a game management tool that allows Users to organize, join, and participate in sports-based grid prediction games ("Games"). The Platform provides:

  • Tools for Commissioners to create and manage Games
  • A system for Players to claim squares in Games using access codes
  • Live score tracking and winner identification
  • Game history and notification services

Sports Ball Squares does not facilitate, process, or hold any monetary transactions of any kind. Any prize pools, entry fees, or payments associated with a Game are organized, managed, and exchanged entirely offline and outside of the Platform by the Commissioner and Players in that Game. Sports Ball Squares has no involvement in, knowledge of, or responsibility for any financial arrangements between Users.

Sports Ball Squares is a free-to-use platform provided for entertainment and organizational purposes only.

4. User Accounts

4.1 Registration

To access certain features of the Platform you must create an account by providing a valid email address, a password, and other requested information. You agree to provide accurate, current, and complete information and to keep your account information updated.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at contact@sportsballsquares.com if you suspect any unauthorized use of your account.

4.3 One Account Per User

You may only maintain one account. Creating duplicate or fraudulent accounts is prohibited and may result in immediate termination of all associated accounts.

4.4 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason including but not limited to violation of these Terms. You may also delete your account at any time through your account settings.

5. Commissioner Responsibilities

Users who create Games ("Commissioners") agree to the following:

5.1 Private Games Only

Commissioners may only invite individuals with whom they have a pre-existing personal, professional, or social relationship. Games must be private and access-controlled via unique codes distributed by the Commissioner.

5.2 Compliance with Local Laws

Commissioners are solely responsible for ensuring that any Game they organize, including any associated prize pool or financial arrangement, complies with all applicable federal, state, local, and international laws and regulations in their jurisdiction and in the jurisdictions of their Players. Sports Ball Squares makes no representation that organizing a sports pool with a prize component is legal in any particular jurisdiction.

5.3 Offline Financial Arrangements

Any financial arrangements, entry fees, or prize distributions associated with a Game are entirely the responsibility of the Commissioner. The Platform provides no tools for collecting, holding, or distributing money, and Sports Ball Squares assumes no liability for any financial disputes between Users.

5.4 Accurate Game Information

Commissioners agree to provide accurate game and series information when creating a Game and to manage their Games in good faith toward all Players.

6. Player Responsibilities

Users who join Games as Players ("Players") agree to the following:

6.1 Compliance with Local Laws

Players are solely responsible for ensuring that their participation in any Game complies with all applicable laws in their jurisdiction. If participation in a sports pool is prohibited in your jurisdiction, you must not participate.

6.2 Offline Financial Arrangements

Players acknowledge that any financial arrangements related to a Game are made entirely outside the Platform and solely between the Player and the Commissioner. Sports Ball Squares is not a party to any such arrangement and assumes no responsibility for any financial disputes.

6.3 Accurate Information

Players agree to provide accurate information when creating an account and claiming squares in any Game.

7. Prohibited Conduct

You agree not to use the Platform to:

  • Violate any applicable law or regulation
  • Organize or participate in Games in jurisdictions where such activities are prohibited
  • Harass, threaten, or harm other Users
  • Use the Platform for any commercial purpose not expressly authorized by Sports Ball Squares
  • Attempt to gain unauthorized access to any part of the Platform or another User's account
  • Introduce malware, viruses, or other harmful code
  • Scrape, copy, or reproduce any part of the Platform without our written consent
  • Impersonate any person or entity
  • Create accounts for automated or bot-driven use
  • Interfere with the proper functioning of the Platform in any way

Violation of these prohibitions may result in immediate account termination and, where applicable, referral to law enforcement.

8. Intellectual Property

All content, features, functionality, design, logos, and trademarks on the Platform are owned by or licensed to Sports Ball Squares and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any Platform content without our express written permission.

You retain ownership of any content you submit to the Platform (such as game titles, square labels, and account information) but grant Sports Ball Squares a non-exclusive, royalty-free license to use, store, and display that content as necessary to operate the Platform.

9. Third-Party Services and Data

The Platform uses third-party services to operate and improve the Platform. By using the Platform, you acknowledge and agree that your data may be shared with these services as described in our Privacy Policy. Current third-party services include Supabase (database and authentication), Lovable (platform hosting and transactional email), HubSpot (CRM and marketing), Twilio (SMS notifications), and ESPN (live score data).

Sports Ball Squares is not responsible for the accuracy, availability, or conduct of any third-party service. Live score data sourced from ESPN is provided for informational and entertainment purposes only. We do not guarantee the accuracy or timeliness of any score data displayed on the Platform.

9.1 Cookies and Tracking Technologies

By using the Platform, you acknowledge and consent to our use of cookies and similar tracking technologies as described in our Privacy Policy. This includes:

  • Strictly necessary cookies required for Platform authentication and session management
  • Analytics cookies used by our Platform provider (Lovable) to monitor Platform performance
  • Marketing and behavioral tracking cookies deployed by HubSpot, including the HubSpot tracking pixel, which may collect information about your visits to our website before and after you create an account

You may manage cookie preferences through your browser settings. Disabling strictly necessary cookies will impair Platform functionality. For more detail on our cookie practices and how to opt out of specific tracking, please refer to our Privacy Policy.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
  • ANY DEFECTS WILL BE CORRECTED
  • THE PLATFORM OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
  • SCORE DATA OR OTHER INFORMATION ON THE PLATFORM IS ACCURATE OR COMPLETE

YOUR USE OF THE PLATFORM IS ENTIRELY AT YOUR OWN RISK.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SPORTS BALL SQUARES AND ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF DATA
  • LOSS OF PROFITS OR REVENUE
  • FINANCIAL DISPUTES BETWEEN USERS
  • ERRORS IN SCORE DATA
  • UNAUTHORIZED ACCESS TO YOUR ACCOUNT
  • ANY FINANCIAL LOSS RELATED TO ANY GAME ORGANIZED OR PARTICIPATED IN THROUGH THE PLATFORM

BECAUSE THE PLATFORM IS FREE TO USE, AND NO CONSIDERATION IS PAID BY USERS TO SPORTS BALL SQUARES, TO THE EXTENT ANY LIABILITY IS FOUND, THE TOTAL AGGREGATE LIABILITY OF SPORTS BALL SQUARES TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED ZERO DOLLARS ($0.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify, defend, and hold harmless Sports Ball Squares and its owners, operators, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Platform
  • Your violation of these Terms
  • Any Game you organize or participate in through the Platform
  • Any financial arrangement you enter into with other Users
  • Your violation of any applicable law or regulation
  • Any third-party claim arising from your conduct on the Platform

13. Gambling and Legal Compliance Disclaimer

Sports Ball Squares is a free game management and organizational tool provided for entertainment purposes only. The Platform does not facilitate, promote, or encourage illegal gambling. Sports Ball Squares does not collect, hold, process, or distribute any money associated with any Game.

The legality of sports pools, prediction games, and associated prize arrangements varies by jurisdiction. It is the sole responsibility of each Commissioner and Player to understand and comply with the laws applicable to them. Sports Ball Squares makes no representation that any particular use of the Platform is lawful in any jurisdiction.

By using the Platform, you acknowledge that you are solely responsible for your own legal compliance and that Sports Ball Squares assumes no liability for any legal consequences arising from your use of the Platform.

14. Dispute Resolution

14.1 Informal Resolution

Before initiating any formal dispute process, you agree to contact us at contact@sportsballsquares.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days of receiving your notice.

14.2 Binding Arbitration

If informal resolution fails, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

You may opt out of this arbitration agreement by sending written notice to contact@sportsballsquares.com within 30 days of first creating your account. Your opt-out notice must include your full name, email address, and a clear statement that you are opting out of arbitration.

14.3 Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST SPORTS BALL SQUARES. ALL DISPUTES MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

14.4 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law principles, except where preempted by applicable federal law.

14.5 Exceptions

Nothing in this Section prevents either party from seeking emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

15. Geographic Scope

Sports Ball Squares is intended for use by residents of the United States and Canada. If you access the Platform from outside these regions, you do so at your own risk and are solely responsible for compliance with all applicable local laws and regulations. We make no representation that the Platform or its content is appropriate or legally permissible in all locations.

Canadian Users should refer to our Privacy Policy for information regarding their rights under the Personal Information Protection and Electronic Documents Act (PIPEDA) and Canada's Anti-Spam Legislation (CASL).

16. Platform Discontinuation

In the event that Sports Ball Squares ceases operations or discontinues the Platform:

  • We will provide at least 30 days advance notice to all registered Users via email where reasonably possible
  • All User data, account information, game history, and associated records stored on the Platform will be permanently deleted and will not be archived, transferred, or sold
  • Sports Ball Squares assumes no liability for any loss of data or disruption to any ongoing Game resulting from Platform discontinuation

17. Changes to the Platform

We reserve the right to modify, suspend, or discontinue any feature or aspect of the Platform at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court or arbitrator of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sports Ball Squares regarding your use of the Platform and supersede all prior agreements, understandings, and representations relating to the same subject matter.
